Chapter 11 is the Chapter of Title 11 of the U.S. Bankruptcy Code which governs the process of re-organization under the bankruptcy laws. When businesses are in trouble and are unable to pay its creditors, it can file (or be forced by its creditors to file) for protection under either Chapter 7 or Chapter 11. A Chapter 7 usually means that the business's assets will be liquidated to pay it's creditors, and then cease operations. Chapter 11 is an attempt to stay in business while the court supervises the re-organization of the company's contractual debt obligations. The court can grant complete or partial relief from most of the company's debts and its contracts, so that the company can make a fresh start. Chapter 13 is ordinarily used by individuals who have fallen behind in payments on their mortgage. Chapter 13 stops foreclosures and forces mortgage holders to take payments on the mortgage arrearage.
